These Terms of Service (the "Terms") are a legally binding agreement between you and Red Ape Mobile ("Company," "we," "us," "our"), a company based in California, United States. These Terms govern your access to and use of Preschool Tracer: ABC & Words (the "App" or the "Service"), together with any related content and services.
By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the App.
Together with Apple's Licensed Application End User License Agreement (which applies to apps distributed through the App Store), these Terms serve as the Terms of Use / EULA for the App.
The App is an educational tracing app designed to be used by young children (approximately ages 3–6) under the supervision of a parent or guardian. Because children cannot enter into a binding legal agreement, "you" in these Terms means the parent or guardian who downloads, installs, or authorizes the use of the App — not the child using it.
By using or authorizing use of the App, you represent that:

The App does not require you or your child to register, create an account, or sign in. There is no username or password to manage. Any preferences you set (such as selected tracing mode or language) are stored locally on your device or, where applicable, via Apple's iCloud/App Store account infrastructure.
We are the owner or licensee of all intellectual property rights in the App, including its source code, design, audio, illustrations, text, and the Zaner-Bloser–style letterform data (collectively, the "Content"), as well as our trademarks, service marks, and logos (the "Marks"). The Content and Marks are protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable, personal license to download and use the App on devices you own or control, for your own personal, non-commercial use. Except as permitted by this license, no part of the App or its Content may be copied, reproduced, distributed, sold, licensed, or otherwise exploited without our express prior written permission.
If you send us feedback, suggestions, or ideas about the App ("Feedback"), you agree that we may use that Feedback for any purpose, including to improve the App, without any obligation or compensation to you.
All purchases in the App — including subscriptions — are processed exclusively through Apple's In-App Purchase system using the payment method on file with your Apple ID. We do not collect or process your payment card details directly, and we do not accept payment by any other method.
Prices are set and displayed by the App Store in your local currency at the time of purchase and may vary by country or region. Apple, not Red Ape Mobile, is responsible for processing your payment and for currency conversion.
The App offers optional auto-renewable subscriptions ("Subscriptions") that unlock full access to all letters, numbers, shapes, and words across every tracing mode. Subscription plans and their current prices are shown in the App and on the App Store product page before you purchase.
The App is licensed to you, not sold. Any related documentation is provided "as is," without warranty of any kind. You may not reverse engineer, decompile, or disassemble the App except as permitted by applicable law.
Your download and use of the App is also subject to the usage rules set forth in the Apple Media Services Terms and Conditions. Apple has no obligation to furnish maintenance or support for the App, and is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce them against you.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY EDUCATIONAL OUTCOME WILL RESULT FROM ITS USE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RED APE MOBILE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO SOME OR ALL OF THIS SECTION MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold us harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
These Terms remain in effect while you use the App. We may suspend or restrict your access to the App at any time, for any reason, including if we believe you have violated these Terms. You may stop using the App, and cancel any Subscription, at any time as described above.
We may update, modify, or discontinue features of the App at any time. We may also revise these Terms from time to time; the "Last updated" date above will reflect the most recent changes. Material changes will be reflected in the App's release notes or on this page. Your continued use of the App after a revised version of these Terms is posted constitutes your acceptance of the changes.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will first be attempted to be resolved informally by contacting us at redapemobile@gmail.com. If a dispute cannot be resolved informally within 30 days, it will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable consumer protection rights you may have under the law of your country of residence.
If you have a complaint that we do not resolve to your satisfaction, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
